AGS Elite Driving School – Terms & Conditions

By booking or attending driving lessons with AGS Elite Driving School, you agree to these Terms & Conditions. “By booking or attending driving lessons with AGS Elite Driving School, you agree to be bound by these Terms and Conditions.”

1. About AGS Elite Driving School

AGS Elite Driving School is a self‑employed driving tuition business operated by Andy, providing professional manual driving tuition in Swansea and surrounding areas.

For all enquiries, bookings, cancellations and complaints, please use the contact details on our Contact page.

2. Eligibility for Tuition

To take lessons with us, you must:

  • Hold a valid UK provisional licence, full UK licence, or recognised overseas licence.

  • Be legally entitled to drive in the UK.

  • Meet all DVLA requirements.

  • Be medically fit to drive.

You must inform your instructor of any medical condition, medication, disability or legal matter that may affect your ability to drive safely.

3. Driving Lessons

  • Lessons follow DVSA standards and best practice.

  • The instructor determines lesson content, objectives, routes, duration and test readiness.

  • No guarantee is given regarding lesson quantity, test readiness date or test success.

Progress depends on individual ability, commitment and experience.

4. Bookings, Fees & Payments

Bookings

  • Lessons may be booked individually or as part of a block booking.

  • All bookings are subject to availability and confirmed once accepted.

  • We reserve the right to refuse or cancel bookings where necessary.

Fees

  • Prices are available on request or via our website.

  • Prices are in Pounds Sterling (£).

  • Price changes do not affect lessons already paid for.

Payments

  • Lessons must be paid in advance unless otherwise agreed.

  • Accepted payment methods include bank transfer, debit/credit card and other approved methods.

  • Failure to pay may result in cancellation or suspension of lessons.

5. Block Bookings

  • Block bookings may include discounted rates.

  • Unused lesson credits remain valid for future use.

  • Refunds are calculated fairly based on lessons taken and discounts applied.

  • Long‑unused balances may be repriced if lesson prices change significantly.

6. Cancellations

Pupil Cancellations

  • A minimum of 48 hours’ notice is required to cancel or rearrange a lesson.

  • Less than 48 hours’ notice, missed lessons or non‑attendance may be charged in full.

  • Genuine emergencies may be considered at the instructor’s discretion.

Instructor Cancellations

Lessons may be cancelled due to illness, vehicle issues, adverse weather or other circumstances beyond reasonable control. In such cases:

  • No charge will be made.

  • Prepaid lessons will be rearranged or credited.

  • Reasonable notice will be given where possible.

7. Refunds

Refunds are available for prepaid lessons not yet taken.

Refunds will not normally be given for:

  • Completed lessons

  • Missed lessons

  • Late cancellations

Approved refunds are usually processed within 10 working days using the original payment method.

8. Driving Tests

8.1 Responsibility for Test Bookings

You are solely responsible for booking, rescheduling and cancelling your Theory and Practical Driving Tests with the DVSA. “The pupil is solely responsible for arranging, booking, rescheduling, and cancelling their own Theory Test and Practical Driving Test.”

8.2 Test Readiness

The instructor may advise on readiness, but the decision to book a test is yours.

8.3 Use of the Instructor’s Vehicle

The instructor may refuse use of the tuition vehicle for a test if:

  • You have not reached a safe driving standard.

  • You are unlikely to meet DVSA test standards.

  • Safety concerns exist.

  • The vehicle is unavailable due to circumstances beyond reasonable control.

8.4 Test Fees & DVSA Issues

AGS Elite Driving School is not responsible for:

  • DVSA test fees

  • Additional fees after a failed test

  • Missed tests

  • DVSA cancellations or postponements

  • Administrative errors made by the pupil

  • DVSA delays or disruptions

9. Use of the Tuition Vehicle

  • The vehicle remains under the instructor’s control at all times.

  • The instructor may take physical control whenever necessary for safety.

  • Pupils must follow all reasonable instructions.

10. Pupil Conduct

Lessons may be terminated immediately if a pupil:

  • Behaves abusively

  • Uses threatening language

  • Acts aggressively

  • Is under the influence of alcohol or drugs

  • Creates a safety risk

No refund will be given where a lesson is terminated due to unacceptable behaviour.

11. Health & Fitness to Drive

You must disclose any condition that may affect your ability to drive safely, including:

  • Medical conditions

  • Prescribed medication

  • Visual impairments

  • Physical disabilities

Failure to disclose may result in suspension or termination of lessons.

12. Insurance

The tuition vehicle is fully insured for learner drivers and maintained in a safe, roadworthy condition.

13. Intellectual Property

All lesson materials, website content, branding and documents remain the property of AGS Elite Driving School and may not be copied or used commercially without permission.

14. Data Protection & Privacy

We process personal information in accordance with UK data protection law for:

  • Lesson administration

  • Communication

  • Record keeping

  • Legal compliance

Personal information is not sold to third parties.

15. Limitation of Liability

AGS Elite Driving School is not liable for:

  • Missed or delayed tests

  • Loss of earnings

  • Business or indirect losses

  • Events outside reasonable control

Nothing excludes liability for negligence causing death or personal injury.

16. Termination of Tuition

Tuition may be discontinued where:

  • Safety concerns exist

  • Payment obligations are not met

  • Pupil conduct is unacceptable

  • The instructor‑pupil relationship has broken down

Unused prepaid lessons may be refunded where appropriate.

17. Complaints

If you are dissatisfied with any aspect of your tuition, please raise it as soon as possible. Complaints may be requested in writing.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of our services constitutes acceptance of any revised Terms.

19. Governing Law

These Terms are governed by the laws of England and Wales.
